The United States Releases New Regulations on Toy Guns

Standard scope of application

The regulations apply to toys that have the appearance, shape and/or configuration of a firearm, products that look like a firearm and imitation firearms equipment.

 

But does not include:

  • A replica antique firearm intended for collection and without a firing function that appears to be authentic and may be a scale model, but is not a toy modeled after an actual firearm designed, manufactured and produced before 1898.
  • A traditional B-B gun, paintball gun, or pellet-firing airsoft gun that fires projectiles by the force of compressed air, compressed gas, or mechanical spring action, or any combination thereof, as described in ASTM F589-85.
  • Decorative and miniature objects having the appearance, shape and/or configuration of a firearm, including items intended to be placed on a table or hung from a bracelet, necklace, keychain, etc., which do not exceed 38 mm in height and 70 mm in length (Does not include any stock length).

 

Exemptions:

Any toy guns, products that look like firearms, and imitation firearms used solely in the theatrical, motion picture, or television industries may be exempted from the marking requirements by submitting a written request to the Consumer Product Safety Commission).

Compliance requirements

Toys that have the appearance, shape and/or configuration of firearms, products that look similar to firearms and imitation firearms equipment must meet at least one of the following conditions:

  • Flame orange (AMS STD 595A-17, color number 12199) or a lighter orange than specified in the AMS standard color number, the solid plug is permanently affixed to the muzzle end of the barrel as an integral part of the entire assembly and is removed from the gun. The muzzle end of the tube is not depressed more than 6 mm;
  • Flame orange (AMS STD 595A-17 color number 12199) or a brighter orange than specified in the AMS standard color number, with the marking permanently affixed to the outer surface of the barrel, covering the barrel circumference to a depth of at least 6 mm from the muzzle end;
  • The device is made entirely of transparent or translucent material that allows for unobstructed viewing of the entire contents of the device; or the entire exterior surface of the device is colored white, bright red, bright orange, bright yellow, bright green, bright blue, bright pink or bright purple, which can be used alone or as a main color in combination with other colors in any pattern.
