STANDARD SCOPE
The regulation applies to toys that have the appearance, shape, and/or configuration of firearms, products that look like firearms, and imitation firearms equipment.

 

BUT NOT INCLUDING:
A collectible non-firing imitation antique firearm that looks real and may be a scale model, but is not a toy modeled after an actual firearm designed, manufactured, and produced before 1898.
A conventional B-B gun, paintball gun, or pellet-launching air gun that fires a projectile by the force of compressed air, compressed gas, or mechanical spring action, or any combination thereof, as described in ASTM F589-85.
Decorative and miniature objects having the appearance, shape and/or configuration of a firearm, including items intended to be placed on a table or hung from bracelets, necklaces, keychains, etc., which do not exceed 38mm in height and 70mm in length (Does not include any stock length).

 

EXEMPTION:
Any toy guns, firearm-like products, and imitation firearms that are intended solely for use in the theatrical, film, or television industry may be exempted from the marking requirement upon written request to the CPSC).
